Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and Virtual Buddy (“Virtual Buddy”, “we”, “us”, or “our”) governing your access to and use of our websites, applications, and the AI-employee services made available at virtualbuddy.app(collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Virtual Buddyprovides a software product that lets creators “hire” an AI assistant to monitor connected social platforms, surface trends, help manage a calendar, and support related creative and operational tasks. The Service relies on third-party AI models and platform integrations. Outputs are generated automatically and may be incomplete, inaccurate, or unsuitable for your particular purpose. You are responsible for reviewing outputs before relying on or publishing them.

2. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of the information you provide, for safeguarding your login credentials, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

3. Connected platforms & third-party services

The Service can connect to third-party platforms (for example, social networks) through authorization mechanisms such as OAuth. When you connect a platform, you authorize us to access, store, and process data from that platform on your behalf, subject to our Privacy Policy. Your use of those platforms remains governed by their own terms. We are not responsible for the availability, accuracy, or conduct of third-party services, and platform changes may affect or interrupt features.

4. Subscriptions, billing & refunds

Paid plans are billed in advance on a recurring basis (monthly or annually) through our payment processor. By subscribing, you authorize recurring charges until you cancel. Fees are exclusive of applicable taxes. Unless required by law or expressly stated otherwise, payments are non-refundable and partial billing periods are not prorated. We may change pricing on a prospective basis with reasonable notice.

5. Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period, and you retain access until then. We may suspend or terminate your access for breach of these Terms, suspected fraud, or to comply with law.

6. Acceptable use

You agree not to:

  • Use the Service to break the law or infringe the rights of others;
  • Generate, distribute, or promote unlawful, deceptive, harassing, or harmful content;
  • Attempt to reverse engineer, probe, or circumvent security or rate limits, or misuse the underlying AI models;
  • Violate the terms of any connected platform, or use the Service to scrape or harvest data you are not authorized to access;
  • Resell, sublicense, or provide the Service to third parties except as permitted.

7. Your content

You retain ownership of the content and data you provide or connect to the Service (“Your Content”). You grant us a limited, worldwide, non-exclusive license to host, process, and transmit Your Content solely to operate and improve the Service and to provide it to you. You are responsible for having the necessary rights to Your Content and for its use.

8. AI outputs

As between you and us, and to the extent permitted by law, you may use the outputs the Service generates for you. Outputs may not be unique and similar outputs may be generated for other users. You are responsible for evaluating outputs for accuracy, originality, and fitness before use.

9. Intellectual property

The Service, including its software, design, and trademarks, is owned by Virtual Buddy and its licensors and is protected by intellectual-property laws. These Terms grant you a limited, revocable, non-transferable license to use the Service for its intended purpose.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that outputs will be accurate or reliable.

11. Limitation of liability

To the maximum extent permitted by law, Virtual Buddy will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our aggregate liability arising out of or relating to the Service will not exceed the amounts you paid us for the Service in the twelve months preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Virtual Buddy and its affiliates from any claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms or applicable law.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by email or in-app notice). Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing law

These Terms are governed by the laws of the jurisdiction in which Virtual Buddy is established, without regard to conflict-of-laws principles. Nothing in these Terms limits any mandatory consumer-protection rights available to you in your country of residence.
